Terms of Service - THE IFMO
These terms define the conditions governing access to and use of THE IFMO, including individual purchases, subscriptions and limitations of liability.
1. Legal Entity
THE IFMO is a trading name of Aafkes B.V., a company registered in the Netherlands.
All services, purchases, subscriptions and agreements are entered into with Aafkes B.V.

2. Scope of services
THE IFMO is offered exclusively to business customers. By purchasing or subscribing, the customer confirms that they are acting in a professional or commercial capacity.
THE IFMO provides independent fragrance market intelligence in the form of reports, analysis, audio editions and related content.
Content is provided for informational and analytical purposes only.
3. Purchases, access and subscriptions
Access to THE IFMO content may be provided through an individual purchase or an active subscription.
For subscriptions:
- Access starts from the first report released after the subscription begins
- A new report and accompanying audio edition are released on the first day of each month
- Reports released prior to the subscription start date are not included, but may be purchased separately through The Library
- Reports and accompanying audio editions received during the subscription remain available through the customer’s account after a new edition is released and after the subscription ends, subject to these terms
Subscriptions renew automatically according to the billing frequency selected at the time of purchase, unless cancelled before the next renewal date.
The Monthly Subscription has a minimum initial term of three (3) months. The Yearly Subscription is billed annually.
After any applicable minimum term, subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No further reports or audio editions will be added after the subscription period ends, but content previously received will continue to be available through the customer’s account, subject to these terms.
Payments already processed are non-refundable, except where otherwise required by applicable law.
Payments are processed through payment service providers integrated with our ecommerce platform.
Aafkes B.V. reserves the right to suspend or terminate access in the event of non-payment, misuse or a material breach of these terms.
4. Digital content and withdrawal
THE IFMO provides digital content and services intended exclusively for professional and business use.
Where a statutory right of withdrawal applies despite the business nature of the transaction, the customer expressly agrees that delivery of digital content may begin immediately and acknowledges that this may result in the loss of any applicable right of withdrawal once delivery has begun, to the extent permitted by applicable law.
5. Intended use
THE IFMO is intended for business users and professionals.
Content may be used for the customer’s own internal business purposes. Reproduction, distribution, publication, sharing, resale or other commercial exploitation of THE IFMO content is not permitted without prior written consent from Aafkes B.V.
Access is granted on a limited, non-exclusive and non-transferable basis.
6. Intellectual property
THE IFMO reports, analyses, written content, audio content, design, methodology and other original materials are protected by applicable intellectual property rights and, unless otherwise stated, belong to Aafkes B.V.
References to third-party information, data, trademarks or other materials remain subject to the rights of their respective owners.
All rights in THE IFMO's original materials are reserved.
7. No advice
THE IFMO provides market intelligence and analysis, not advice.
Nothing in THE IFMO content should be interpreted as financial, investment, legal or strategic advice, or as a recommendation to take a particular business decision.
Customers remain responsible for their own interpretation of the information and for any decisions made on the basis of THE IFMO content.
8. Limitation of liability
To the maximum extent permitted by applicable law, Aafkes B.V. shall not be liable for indirect, consequential or special damages, including loss of profit, revenue, data or business opportunities arising from the use of THE IFMO content or services.
Nothing in these terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
9. Accuracy and nature of intelligence
THE IFMO is based on information from multiple sources, including publicly available information, combined with structured research and analysis.
THE IFMO reflects the evidence, interpretations, uncertainties and confidence levels available at the time of publication. Intelligence may be strengthened, challenged, revised or reframed as new information becomes available.
While we aim to provide rigorous and consistent analysis, we do not guarantee that information is complete, error-free or suitable for any particular business decision.
Continuous or uninterrupted availability of the service is not guaranteed.
10. Service changes
Aafkes B.V. may modify, suspend or discontinue parts of THE IFMO where reasonably necessary for the operation, development or improvement of the service.
Such changes do not affect rights already acquired in relation to content previously purchased.
11. Force majeure
Aafkes B.V. shall not be liable for delays or failure to perform obligations resulting from circumstances beyond its reasonable control.
12. Changes to these terms
We may update these terms from time to time to reflect changes in THE IFMO, our services or applicable requirements.
The version applicable at the time of purchase or subscription will govern that transaction, except where changes are required by law or relate to the ongoing operation of the service.
13. Governing law
These terms are governed by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands.

Payment information is processed through our payment service providers. We do not intentionally collect sensitive personal data.

- Digital subscription and content-delivery services, including Content Vault
- Digital download services, including ABC Digital Downloads
- Email, invoicing, analytics and other technical service providers where required to operate THE IFMO
These providers may process personal data where necessary to provide their services to us. In some circumstances, a provider may also process personal data for its own purposes in accordance with its own privacy terms.
5. International transfers
Some of our service providers may process personal data outside the European Economic Area (EEA).
Where required by applicable data protection law, appropriate safeguards are used for international transfers, such as adequacy decisions or approved contractual safeguards, including Standard Contractual Clauses.
